General Terms and Conditions of Goldpiercingart - Goldschmiede Mandat

§1 Scope of Application and Definition of Terms

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity.

§2 Conclusion of Contract, Storage of the Contract Text

(1) The following provisions on the conclusion of a contract apply to orders placed via our online shop at www.goldpiercingart.de.

(2) In the event of the conclusion of a contract, the contract is concluded with

(3) The presentation of goods in our online shop does not constitute a legally binding contractual offer on our part, but merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

Acceptance of the offer takes place in writing, in text form, or by dispatch of the ordered goods within one week. If this period expires without result, the offer shall be deemed rejected.

(4) Upon receipt of an order in our online shop, the following provisions apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order is placed in the following steps:
1) Selection of the desired goods
2) Confirmation by clicking the “Order” button
3) Review of the information in the shopping cart
4) Clicking the “Checkout” button
5) Logging into the online shop after registration and entering the login details (email address and password)
6) Further review and/or correction of the data entered
7) Binding submission of the order

Before the binding submission of the order, the consumer may return to the webpage on which the customer’s details are recorded by using the “Back” button in the internet browser used by the consumer after reviewing their details, and correct input errors, or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by means of an automatically generated email (confirmation of receipt). This does not yet constitute acceptance of the offer. Acceptance of the offer takes place in writing, in text form, or by dispatch of the ordered goods within one week.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order data and our General Terms and Conditions by email. You can also view the General Terms and Conditions at any time at www.goldpiercingart.de/shop/page/terms. If you have registered with us, you can view your previous orders in our customer area under “View Orders”.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components. Any shipping costs will be charged separately.

(2) The consumer has the option of payment by advance payment, direct debit, or PayPal.

(3) If the consumer has chosen payment in advance, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch.

(2) If the consumer has chosen payment in advance, we will not dispatch the goods before receipt of payment.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been made.

§6 Right of Withdrawal

Withdrawal Instructions

There is no right of withdrawal for goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. This applies in particular to custom-made products.

There is also no right of withdrawal for sealed piercing jewellery which is not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery.

For all other purchase contracts, the following applies:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.

If you make use of this option, we will immediately send you confirmation of receipt of such withdrawal (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is earlier.

You must send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you inform us about the withdrawal from this contract, to:

The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
